TaxBE is an AI-powered decision-support tool. Nothing in this service constitutes professional tax, legal, or financial advice. Always verify AI-generated results with a qualified Belgian tax professional before making any changes to your official tax return. Devium accepts no liability for tax penalties or financial loss arising from reliance on TaxBE's output.
1. Acceptance of Terms
By accessing or using TaxBE at taxbe.ai ("Service"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree with any part of these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you ("User") and Devium ("Company"), a company established under Belgian law.
2. Service Description
TaxBE is an AI-powered tax analysis platform offering the following tools to Belgian taxpayers:
- Tax Proposal Optimizer: Analyzes your uploaded Belgian tax proposal (PDF from Tax-on-web / MyMinfin) and suggests potential deductions via an AI chat interface.
- Self-Assessment Tool: Guides users without a proposed return through common Belgian tax codes, based on income and personal situation inputs.
- Legal Assistant: Provides general information about Belgian tax law based on publicly available legal texts.
3. AI Disclaimer — Not Professional Advice
3.1 TaxBE provides AI-generated informational content only. Nothing in our Service constitutes professional tax advice, legal advice, accounting advice, or financial advice of any kind.
3.2 The AI-generated analysis, deduction suggestions, tax code recommendations, and savings estimates are indicative only. They are generated by a Large Language Model (LLM) and may contain errors, inaccuracies, omissions, or outdated information.
3.3 You must not submit your official Belgian tax return based solely on TaxBE's output without first consulting a qualified, licensed Belgian tax professional (belastingconsulent / conseiller fiscal) or certified accountant (erkend accountant / expert-comptable).
3.4 Devium expressly disclaims all responsibility for:
- Tax penalties, interest charges, surcharges, or additional assessments levied by the Belgian tax authorities (FPS Finance / SPF Finances) resulting from reliance on TaxBE's output.
- Errors or omissions in AI-generated tax codes, amounts, or deduction instructions.
- Any financial loss, opportunity cost, or damage arising from reliance on the Service.
3.5 Belgian tax law is highly complex and individual. TaxBE's AI cannot account for all personal circumstances, recent legislative changes, administrative circulars, or case-specific nuances that a qualified professional would consider.
3.6 The Service is a decision-support tool, not a decision-making tool.
4. User Eligibility
4.1 You must be at least 18 years old to use TaxBE.
4.2 TaxBE is intended for Belgian residents filing Belgian personal income tax returns (Personenbelasting / Impôt des personnes physiques).
4.3 By using the Service, you represent that you are legally capable of entering into a binding contract under Belgian law.
5. User Responsibilities and Obligations
5.1 Accuracy of information: You are solely responsible for the accuracy and completeness of any information, data, or documents you provide to TaxBE. The quality of AI-generated output entirely depends on the accuracy of your inputs.
5.2 Document ownership: By uploading a document, you confirm that:
- You are the owner of the tax document, or are duly authorised to act on behalf of the named individual.
- You are not uploading documents on behalf of third parties without their explicit written consent.
5.3 Professional verification: You agree to verify all TaxBE output with a qualified tax professional before taking any action on your official tax return.
5.4 Account security: If you have an account, you are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
5.5 Compliance with law: You agree to use TaxBE only for lawful purposes and in accordance with applicable Belgian and EU law.
6. Payment Terms
6.1 The AI-powered tax analysis and chat features are provided free of charge. If the AI identifies potential savings, you may optionally unlock a detailed results report for a fee.
6.2 Pricing: The unlock fee is calculated as 1% of identified tax savings, subject to a minimum of €2.50 and a maximum of €10.00. If identified savings are equal to or less than the service fee, the full report is provided free of charge.
6.3 Payment processing: All payments are processed by Mollie B.V. (mollie.com), a licensed payment institution supervised by the Dutch Authority for the Financial Markets (AFM) and the European Central Bank. Devium never stores your card number or sensitive payment authentication data.
6.4 Refund policy: Due to the digital and immediate nature of the Service, no refunds are offered once you have accessed your unlocked results report. If a technical failure prevented you from accessing results after a confirmed payment, contact info@taxbe.ai within 7 days and we will investigate.
6.5 VAT: Prices displayed include Belgian VAT (BTW/TVA) where applicable.
6.6 Result access period: Paid results remain accessible for 30 days from the date of payment, after which data is automatically deleted for GDPR compliance.
7. Intellectual Property
7.1 TaxBE, including its software, algorithms, interface design, branding, and content, is the intellectual property of Devium, protected by Belgian and EU intellectual property law.
7.2 Your use of the Service grants you no ownership rights over the Service or its components.
7.3 You retain full ownership of any documents and data you upload. By uploading, you grant Devium a limited, non-exclusive, non-transferable licence to process your data solely to provide the Service to you.
7.4 AI-generated output is licensed to you for personal, non-commercial use only. You may not resell, redistribute, or commercially exploit results generated by TaxBE without Devium's prior written consent.
8. Limitation of Liability
To the maximum extent permitted by applicable Belgian law:
8.1 Devium shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, loss of data, tax penalties, fines, interest charges, additional tax assessments, or loss of goodwill attributable to your use of or inability to use the Service.
8.2 Devium's total aggregate liability arising out of or in connection with the Service — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — shall not exceed the amount you actually paid for the specific service transaction giving rise to the claim, or €10.00, whichever is lower.
8.3 Nothing in these Terms shall limit or exclude liability for: (a) death or personal injury caused by Devium's gross negligence; (b) fraud or fraudulent misrepresentation; (c) any other liability that cannot be excluded or limited under mandatory Belgian consumer protection law (Book VI of the Code of Economic Law / Wetboek Economisch Recht).
8.4 Belgian consumer protection legislation grants certain non-waivable rights to consumers. These Terms do not affect those statutory rights.
9. Disclaimer of Warranties
9.1 TaxBE is provided "as is" and "as available" without warranty of any kind, whether express or implied.
9.2 We do not warrant that: (a) the Service will be uninterrupted, error-free, or secure at all times; (b) errors will be corrected; (c) the Service meets your specific requirements; (d) AI-generated results will be accurate, complete, or fit for any particular tax-related purpose.
9.3 The applicability of specific tax deductions to your individual circumstances must be verified by a licensed tax professional.
10. Indemnification
You agree to defend, indemnify, and hold harmless Devium, its directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms; (b) your misuse of the Service; (c) your violation of applicable law; (d) your submission of documents or personal data belonging to third parties without authorisation; or (e) any fraudulent or misleading information you provided to TaxBE.
11. Prohibited Uses
You agree not to:
- Use the Service for any unlawful purpose or in violation of applicable Belgian or EU law
- Upload tax documents or personal data belonging to others without their explicit written authorisation
- Attempt to probe, scan, or test the security vulnerability of our systems
- Transmit viruses, malware, ransomware, or other malicious code
- Attempt to reverse-engineer, decompile, or disassemble the Service or its components
- Use automated scripts, bots, crawlers, or scrapers to access the Service at scale
- Use the Service commercially to process tax data for third-party clients without a separate commercial agreement with Devium (applicable to tax advisory firms, accountants, or similar)
- Impersonate another person, entity, or tax professional
- Misrepresent the origin, accuracy, or authority of AI-generated results to third parties
12. Service Availability & Modifications
12.1 Devium does not guarantee continuous, uninterrupted access to the Service. We may suspend, discontinue, or modify the Service at any time for maintenance, security, or legal reasons, with or without prior notice.
12.2 We reserve the right to modify these Terms at any time. Material changes will be communicated via a prominent notice on taxbe.ai. Continued use after notification constitutes acceptance of the revised Terms.
12.3 We may restrict or terminate access to accounts or sessions if we reasonably believe you have violated these Terms.
13. Third-Party Links & Services
TaxBE may contain links to third-party websites or services (e.g., Tax-on-web / MyMinfin at eservices.minfin.fgov.be). These links are provided for convenience only. Devium has no control over and accepts no liability for the content, privacy practices, or availability of any third-party service.
14. Governing Law & Jurisdiction
14.1 These Terms are governed by and construed in accordance with the laws of Belgium, without regard to conflict-of-law provisions.
14.2 Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of Brussels, Belgium.
14.3 If you are a consumer residing in the EU, you also have the right to use the EU Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.
14.4 Belgian consumer protection law (Book VI WER/CDE) grants consumers statutory rights that cannot be waived by contract. Nothing in these Terms overrides those mandatory protections.
15. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a competent court, that provision shall be modified to the minimum extent necessary, or severed, and the remaining provisions shall continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Devium regarding your use of TaxBE and supersede all prior agreements, negotiations, and understandings.
